Lollapalooza ‘Last Band Standing Remix” Contest 2011

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The 2011 Lolla Remix Throwdown ("Contest") begins at 12:00:01 a.m. Central Standard Time ("CST") May 10th, 2011 and ends at 11:59 p.m. CST on July 30th, 2011 ("Contest Period"). In these Official Rules, “Sponsor” means C3 Presents, LLC and its employees, officers, directors, members, managers, sponsors, and agents. Entries submitted after Contest Period will not be considered or judged. “Festival” means the 2011 Lollapalooza Music Festival scheduled for August 5-7, 2011 in Chicago, Illinois. The winner will be announced on or about August 5, 2011.


Void wherever prohibited or restricted by law. Contest may only be entered from and in eligible jurisdictions. All federal, state, and local laws and regulations apply.  By participating in the Contest, you are granting Sponsor an irrevocable right and license to publish, use, edit, and display any or all of the content in your submission, without further approval, without territorial, time, or other limitations, for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes, including audio visual uses.  By participating in the Contest, you are also granting Sponsor the irrevocable right and license to use your name, image, and likeness for any and all purposes, including, but not limited to, marketing, advertising, and promotional purposes,  including audio visual uses. 


The winners will be selected in accordance with the published judging procedure.  No alternative prize, cash, or other substitution is permitted except by Sponsor in the event of prize unavailability. Prizes are non-transferable. All federal, state, and local taxes are the sole responsibility of Winners. Finalists (or their parents or guardians if finalists are under the age of 18) will be required to sign a waiver and release in order to perform in Chicago as part of this Contest.


Eligibility: Chicago residents must, upon request, show proof of residency in the greater Chicago, Illinois area.  No more than one entry per household will be eligible.  No employee or immediate family member of Sponsor is eligible to enter the contest.  Sponsor reserves the right to verify eligibility and to adjudicate on any dispute at any time.


Odds of winning. The odds of winning depend upon the number of entries received and the decisions of the judges.


General Terms and Conditions:

By participating in the Contest, entrant agrees that under no circumstances, including, but not limited to, negligence, will Sponsor, Contest sponsors, Festival sponsors, and their respective officers, directors, employees, members, shareholders, agents, successors, and assigns (the "Released Parties") be liable for any direct, indirect, incidental, special, or consequential damages arising out of participation in the Contest, even if any or all of the Released Parties have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. By participating in the Contest, entrant waives any and all rights to bring any claim or action related to his/her/its participation in any forum beyond one (1) year after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based. By entering, each entrant agrees to be bound by these Official Rules and the decisions of Sponsor, which will be final. Sponsor reserves the right to disqualify any person, entry, vote, or e-mail address that Sponsor determines to be in violation of any term contained in these Official Rules. Sponsor and their respective parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, and the respective employees, officers, directors, shareholders, agents, and representatives of each, are not responsible for and will not be liable for: (i) late, lost, delayed, damaged, misdirected, stolen, incomplete, illegible, unintelligible or postage-due entries, notices, releases, forms, affidavits, or other correspondence; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, interruptions or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Contest to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result from participation in the Contest or arising from the entrant's access to and use of the Internet site http://www.do312.com/remix (and all related websites of Sponsor, including www.lollapalooza.com, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy, to the extent permitted by law; or (vi) any errors in any materials associated with the Contest. Sponsor reserves the right to cancel, suspend and/or modify the Contest if any problem corrupts the administration, security, or operation of the Contest, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Each person is entitled to one vote per email address per day.  Votes will be removed for any DJ where 15% or greater of their votes come from one IP address. 

Contest Timeline:

(1) Open Round:
DJs have from May 10th – May 22nd to submit their best original song or remix of 10 minutes or less and generate as many votes as possible.  The Sponsor will publicly post the DJs’ musical submissions and the DJs can  spread the word everywhere: via their website, Facebook, MySpace, Twitter, at their gigs, radio interviews, and more. At the end of the period, scores will be determined by industry score and the voting score. The top 40 DJs with the most public votes and 10 DJs selected by the industry judging panel will move on to the next round.

  1. (2) Semifinals:
    The competition heats up as the Top 50 DJs will create and upload their best remix of tracks provided by Lollapalooza.  The votes are reset, and the finalists have from June 6th - July 1st to collect as many votes as possible. The four finalists will be determined by a combination of fan votes and judges’ scoring. Voting ends July 1st, midnight CST.  Winners will be determined by a combination of voting and industry score.


  1. (3) Finals:

July 30th, Double Door (Chicago). The four finalists will be invited to Chicago to compete in the finale event, where one DJ will be picked to play at Lollapalooza.  All finalists are responsible for travel arrangements to Chicago and accommodations for the finals.  Each finalist must notify the Sponsor on or before July 5th, 2011 of the finalist’s intention to participate in the finals, and failure to do so will cause the finalist to forfeit the right to participate in the finals. The winning DJ will be chosen by an industry judging panel.


For all submissions beginning with the open round: the person submitting an entry must own the content of the entry or have the legal authority to use the content.  In the event of a dispute as to authorship or right to use, sponsor reserves the right to disqualify any entry, votes, or winner.  Sponsor’s decisions are final.  By participating in the Contest, entrant agrees that entrant shall not retain any rights in and to the master recordings (“Recordings”) and musical compositions (Compositions”) embodied on the mix submitted by entrant hereunder.  As between entrant and Sponsor, any and all Recordings and Compositions submitted by entrant shall be considered works-made-for-hire, and Sponsor shall own such Recordings and Compositions, together with the performances embodied therein and all copyrights therein and thereto, and all of the results and proceeds of entrant’s services hereunder throughout the universe in perpetuity, free of any and all claims.  To the extent the Recordings and Compositions are not considered works-made-for-hire, then entrant hereby transfers and assigns entrant’s entire copyright interest to Sponsor, including all renewals and extensions thereof, and waives any right of copyright termination or recapture in favor of Sponsor.  



Prizes:

The winning DJ will be listed as part of the Festival’s official lineup and receive an opening slot on Perry’s stage at the Festival.  The winner will receive one artist pass with access to catering and the artist lounge and one artist guest pass.  The winner will also receive: a hotel room for four nights in Chicago; two Pioneer CDJ850 tabletop multi players; Set of Shure 550DJ headphones; $250 gift certificate for SatelliteRecords.com; A $1,000.00 prize; Eight hours of custom one on one training in topic of choice from Music Industry Workshop; Four hour hands on training program in digital mastering from Music Industry Workshop; flight stipend of up to $500 plus lodging to spend one 9-hour day with an engineer in the Los Angeles Red Bull Studio and promotion on the Festival website.  The other three contestants in the final will each receive 2 Festival tickets; Shure 550DJ headphones; Four hour hands on training program in digital mastering from Music Industry Workshop; $150 gift certificate to SatelliteRecords.com and a $750.00 prize.  


A winner's list will be posted on the web site at http://www.do312.com/remix, on the World Wide Web at the conclusion of the Contest. To obtain a copy of the winner list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to: Last Band Standing Remix, C3 Presents, LLC, 98 San Jacinto Blvd, Suite 400, Austin, TX, 78701. Requests must be received no later than October 1, 2011.
